Welcome to BuildLabs3D. These Terms and Conditions (“Terms”) govern your access to and use of buildlabs3d.com (the “Site”), including all purchases, products, content, features, and services offered by BuildLabs3D (“BuildLabs3D,” “we,” “us,” or “our”).

By visiting the Site, creating an account, placing an order, submitting content, or otherwise using our services, you agree to be bound by these Terms and our Privacy Policy, Return and Refund Policy, and any other policies displayed on the Site.

Please read these Terms carefully before using the Site. If you do not agree with these Terms, you should not access the Site or use our services.

1. Eligibility and Use of the Site

You must be legally capable of entering into a binding agreement to make a purchase through the Site.

If you are under the age of majority where you live, you may use the Site only with the permission and supervision of a parent or legal guardian.

By using the Site, you represent that:

  • The information you provide is accurate and complete;
  • You are authorized to use the payment method submitted;
  • Your use of the Site complies with applicable law;
  • You will not use our products or services for an unlawful purpose; and
  • You will comply with these Terms.

We reserve the right to refuse service, cancel orders, restrict access, or terminate accounts where reasonably necessary to protect BuildLabs3D, our customers, or the Site.

2. Products and 3D-Printed Characteristics

BuildLabs3D sells products manufactured using 3D-printing processes.

Because 3D-printed products are manufactured layer by layer, individual products may have minor variations, including:

  • Visible layer lines;
  • Minor surface texture;
  • Small support-removal marks;
  • Slight differences in color or finish;
  • Minor dimensional variations within reasonable manufacturing tolerances;
  • Minor differences between product photographs and the finished item; and
  • Small variations between separate production batches.

These characteristics are normal features of the 3D-printing process and are not generally considered defects.

We make reasonable efforts to display product colors, dimensions, features, and images accurately. However, colors may appear differently depending on your screen, lighting, material batch, and device settings.

Product dimensions and weights listed on the Site may be approximate.

3. Product Descriptions and Availability

We make reasonable efforts to ensure that product descriptions, photographs, prices, specifications, and availability information are accurate.

However, we do not guarantee that all information on the Site will always be complete, current, or free from errors.

We reserve the right to:

  • Correct errors or inaccuracies;
  • Update product information;
  • Change product designs or materials;
  • Discontinue products;
  • Limit product quantities;
  • Reject or cancel orders; and
  • Modify prices before an order is accepted.

Products are offered subject to availability. Adding an item to your shopping cart does not reserve the product or guarantee availability.

4. Orders and Order Acceptance

Submitting an order through the Site is an offer to purchase the selected products.

An order confirmation email acknowledges that we received your order, but it does not necessarily mean that the order has been accepted or entered into production.

We reserve the right to reject, limit, or cancel an order for reasons including:

  • Product unavailability;
  • Pricing or description errors;
  • Payment authorization problems;
  • Suspected fraud or unauthorized activity;
  • Shipping restrictions;
  • Customer-requested content that violates these Terms;
  • Orders placed for resale without authorization; or
  • Circumstances that prevent us from reasonably fulfilling the order.

If we cancel an order after payment has been processed, we will issue an appropriate refund to the original payment method.

5. Prices, Payments, and Taxes

All prices displayed on the Site are shown in the currency indicated at checkout.

Prices may change without notice. Price changes do not affect orders that have already been accepted, except where correction is required because of an obvious pricing error.

You agree to provide accurate and current billing, payment, and contact information.

By submitting payment information, you represent that:

  • You are authorized to use the selected payment method;
  • The information provided is accurate;
  • The payment provider may process the transaction; and
  • You are responsible for all authorized charges associated with the order.

Applicable sales tax, shipping charges, and other fees will be displayed at checkout when required.

Payments may be processed by third-party payment providers. BuildLabs3D does not generally receive or directly store complete credit or debit card numbers.

6. Production and Processing Times

Some BuildLabs3D products may be manufactured after an order is placed.

Processing and production times may vary depending on:

  • Product type;
  • Order quantity;
  • Material availability;
  • Color selection;
  • Customization requirements;
  • Production demand;
  • Equipment maintenance; and
  • Quality-control requirements.

Any production or processing time shown on the Site is an estimate and not a guaranteed completion date.

We may contact you if an unexpected production delay occurs.

7. Shipping and Delivery

Shipping rates and estimated delivery times are displayed during checkout or elsewhere on the Site.

Delivery estimates are not guarantees. Delivery may be affected by circumstances outside our reasonable control, including:

  • Carrier delays;
  • Weather;
  • Holidays;
  • Customs processing;
  • Incorrect addresses;
  • Transportation interruptions;
  • Natural disasters; and
  • Other unexpected events.

Customers are responsible for providing a complete and accurate shipping address.

BuildLabs3D is not responsible for delays or losses caused by an incorrect, incomplete, or undeliverable address supplied by the customer.

If an order is returned to us because of an address problem, refusal of delivery, or failure to collect the package, additional shipping charges may apply before the order can be sent again.

Ownership and risk of loss transfer as permitted by applicable law and the shipping method used.

8. Product Safety and Proper Use

Customers are responsible for reading and following all product descriptions, instructions, age recommendations, warnings, and safety information.

Some products may contain small parts or moving components and may not be suitable for young children.

Unless a product page expressly states otherwise:

  • Products should be kept away from open flames and excessive heat;
  • Products should not be placed in ovens, microwaves, or dishwashers;
  • Products should not be used for food preparation or food storage;
  • Products should not be used as medical devices;
  • Products should not be used as protective or safety equipment;
  • Products should not be used in safety-critical applications; and
  • Children should use age-appropriate products under responsible adult supervision.

Products described as sensory, calming, focus, fidget, clicker, or educational products are not medical devices and are not intended to diagnose, treat, cure, or prevent any medical or psychological condition.

Do not continue using a product that becomes cracked, broken, deformed, or develops loose or sharp components.

BuildLabs3D is not responsible for damage resulting from misuse, unauthorized modification, improper storage, failure to follow instructions, or use for a purpose not reasonably intended by the product description.

9. Custom and Personalized Products

Where customization is offered, customers are responsible for reviewing and accurately submitting all requested information, including:

  • Names;
  • Text;
  • Colors;
  • Dimensions;
  • Design choices;
  • Images;
  • Files; and
  • Other specifications.

BuildLabs3D is not responsible for errors contained in information approved or submitted by the customer.

Custom or personalized orders may not be changed or canceled after design preparation or production has begun.

Custom products are subject to the terms of our Return and Refund Policy.

We reserve the right to reject any customization request that:

  • Violates applicable law;
  • Infringes intellectual property rights;
  • Contains threatening, hateful, discriminatory, obscene, or abusive content;
  • Promotes dangerous or unlawful conduct;
  • Could create an unsafe product;
  • Is technically unsuitable for 3D printing; or
  • Otherwise violates these Terms.

10. Customer-Submitted Designs and Intellectual Property

When you submit a design, image, model, file, logo, name, text, or other material, you represent that:

  • You own the material or have permission to use it;
  • BuildLabs3D may use it to produce and fulfill your order;
  • The material does not infringe another party’s copyright, trademark, patent, privacy, publicity, or other rights; and
  • The material does not violate applicable law.

You grant BuildLabs3D a limited, non-exclusive license to use, reproduce, modify, format, and process submitted materials only as reasonably necessary to:

  • Evaluate the request;
  • Prepare the product;
  • Manufacture the order;
  • Communicate with you;
  • Perform quality control;
  • Fulfill the order; and
  • Address customer service matters.

Submitting content does not transfer ownership of your original intellectual property to BuildLabs3D.

You are responsible for claims resulting from materials you submit without the necessary rights or permissions.

11. Returns, Refunds, and Cancellations

Returns, refunds, replacements, exchanges, and cancellations are governed by our Return and Refund Policy available on the Site.

By placing an order, you acknowledge that:

  • Certain custom or personalized products may be final sale;
  • Return authorization may be required;
  • Products must meet the eligibility conditions stated in the Return and Refund Policy;
  • Customer-paid return shipping may apply in certain circumstances; and
  • Normal 3D-printing characteristics are not generally considered defects.

If these Terms conflict with our Return and Refund Policy regarding a return or refund, the Return and Refund Policy will control for that specific matter.

12. Accounts and Account Security

Certain Site features may allow or require you to create an account.

You are responsible for:

  • Providing accurate account information;
  • Keeping your password confidential;
  • Restricting access to your account and devices; and
  • Notifying us promptly of suspected unauthorized access.

You are responsible for activity conducted through your account unless prohibited by applicable law.

We may suspend or terminate an account that appears to be fraudulent, compromised, abusive, or in violation of these Terms.

13. Reviews, Feedback, and Other Content

You may have the opportunity to submit product reviews, photographs, comments, suggestions, or other content.

You agree not to submit content that:

  • Is false or misleading;
  • Violates another person’s rights;
  • Contains confidential or private information;
  • Is threatening, abusive, discriminatory, obscene, or unlawful;
  • Contains malware or harmful code;
  • Advertises unrelated products or services;
  • Impersonates another person; or
  • Manipulates ratings or reviews.

You retain ownership of content you create. However, by submitting content for public display, you grant BuildLabs3D a non-exclusive, worldwide, royalty-free license to use, reproduce, display, format, and distribute that content in connection with the Site, our products, and our business.

We may remove content that violates these Terms or is otherwise inappropriate for the Site.

14. Intellectual Property of BuildLabs3D

The Site and its content, including product designs, photographs, graphics, logos, text, videos, page layouts, branding, and software, are owned by or licensed to BuildLabs3D and are protected by applicable intellectual property laws.

You may use the Site only for personal, lawful, and non-commercial shopping purposes.

Without our written permission, you may not:

  • Copy or reproduce Site content;
  • Sell or commercially exploit Site content;
  • Use our branding or logos;
  • Copy proprietary product designs;
  • Scrape or automatically extract Site data;
  • Create confusingly similar websites or accounts;
  • Remove copyright or ownership notices; or
  • Represent yourself as affiliated with BuildLabs3D.

No license or ownership right is granted except for the limited right to use the Site under these Terms.

15. Prohibited Uses

You may not use the Site or our services to:

  • Violate any applicable law;
  • Commit or facilitate fraud;
  • Submit false information;
  • Infringe intellectual property rights;
  • Interfere with Site security;
  • Upload viruses or malicious code;
  • Attempt unauthorized access to systems or accounts;
  • Collect information about other users without permission;
  • Use automated tools to scrape or overload the Site;
  • Place fraudulent or unauthorized orders;
  • Harass or harm another person;
  • Circumvent purchasing restrictions; or
  • Use our products or services for unlawful or unsafe purposes.

We may report suspected illegal activity to appropriate authorities where required or permitted by law.

16. Third-Party Services and Links

The Site may contain links to or integrations with third-party services, including:

  • Payment providers;
  • Shipping carriers;
  • Social media platforms;
  • Analytics providers;
  • Advertising providers; and
  • Other external websites.

BuildLabs3D does not control and is not responsible for the content, availability, security, terms, or privacy practices of third-party services.

Your use of a third-party service may be governed by that party’s separate terms and policies.

17. Privacy

Our collection and use of personal information are described in our Privacy Policy.

By using the Site, you acknowledge that information may be processed by BuildLabs3D and the service providers needed to operate the Site, process payments, fulfill orders, provide support, and deliver products.

18. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Site and its content are provided on an “as available” basis.

Except for any express warranty clearly stated on a product page or required by law, BuildLabs3D does not make additional warranties regarding:

  • Uninterrupted Site availability;
  • Error-free operation;
  • Compatibility with every intended use;
  • Results obtained from using a product;
  • Exact color matching between screens and physical products; or
  • Suitability for a purpose not expressly described on the product page.

Nothing in these Terms excludes warranties, rights, or remedies that cannot lawfully be excluded.

19. Limitation of Liability

To the maximum extent permitted by applicable law, BuildLabs3D will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from:

  • Use or inability to use the Site;
  • Improper use of a product;
  • Unauthorized product modification;
  • Customer-submitted errors;
  • Third-party services;
  • Delivery delays outside our reasonable control; or
  • Loss of data, revenue, opportunity, or profits.

Where liability cannot be completely excluded, BuildLabs3D’s total liability relating to a particular order will not exceed the amount the customer paid for the product giving rise to the claim, except where applicable law requires otherwise.

Nothing in these Terms limits liability where doing so would be unlawful, including liability that cannot legally be excluded for fraud, intentional misconduct, or certain personal injuries.

20. Indemnification

To the extent permitted by applicable law, you agree to be responsible for reasonable claims, damages, losses, or expenses resulting from:

  • Your unlawful use of the Site;
  • Your material violation of these Terms;
  • Your infringement of another person’s rights;
  • Content or designs you submit without authorization; or
  • Your intentional misuse or unsafe modification of a product.

This section does not require you to indemnify BuildLabs3D for conduct for which BuildLabs3D is legally responsible.

21. Service Changes and Termination

We may modify, suspend, or discontinue parts of the Site when reasonably necessary, including for:

  • Maintenance;
  • Security;
  • Technical problems;
  • Business changes;
  • Legal compliance; or
  • Product or service updates.

We may restrict or terminate access for users who materially violate these Terms, engage in fraud, misuse the Site, or threaten the security of our services.

Sections that logically should remain effective after termination will continue to apply.

22. Governing Law and Disputes

These Terms are governed by the laws applicable to BuildLabs3D and the transaction, without excluding consumer protections that legally apply based on the customer’s location.

Before beginning formal legal proceedings, you agree to contact us at buildlabs3d.contact@gmail.com and make a reasonable effort to resolve the dispute directly.

Any unresolved dispute may be submitted to a court or other forum with lawful jurisdiction over the matter.

Nothing in this section prevents either party from seeking urgent legal relief or exercising rights that cannot legally be waived.

23. Changes to These Terms

We may update these Terms periodically to reflect changes in:

  • Our products or services;
  • The Site;
  • Business practices;
  • Technology;
  • Applicable laws; or
  • Operational requirements.

The updated version will be posted on the Site with a revised “Last Updated” date.

Changes will apply prospectively from the date they are posted unless applicable law requires otherwise.

Your continued use of the Site after updated Terms become effective constitutes acceptance of the updated Terms.

24. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permitted.

The remaining provisions will continue in effect.

25. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.

A waiver is effective only when expressly provided in writing.

26. Entire Agreement

These Terms, together with our Privacy Policy, Return and Refund Policy, and other policies posted on the Site, form the entire agreement between you and BuildLabs3D regarding your use of the Site and purchases made through it.
